The VAT number is FR38928500628. Hereafter referred to as "the Publisher."

This policy applies to any individual or legal entity registered on the site to make a purchase, hereafter referred to as "the Client."

2. Definitions

  • Client: Any individual or legal entity registered on the website.
  • Site Content: Any material published on the website, including text, images, designs, videos, databases, or software.
  • Publisher: Refers to Foy Global Wines, SARL, as the publisher of the website.
  • User: Any individual or legal entity visiting the website.

Access to the website is free and open to all Users. Browsing the site implies acceptance of the terms and conditions. This acceptance will be confirmed during registration by checking the relevant box. This act will be considered equivalent to a handwritten signature.

The website’s primary purpose is the sale of products to Clients.

5. Order Process

  1. Order Placement: Clients select one or more products and add them to their cart. Once ready, they may proceed to checkout.
  2. Order Review: Clients can review their selections, adjust quantities, and proceed if everything is correct.
  3. Payment: After confirming order details, clients are directed to a secure payment interface to complete the transaction.
  4. Order Confirmation: Once payment is received, the Publisher will send a confirmation email to the Client within 24 hours.

6. Pricing & Payment

  • 6.1 Pricing: Prices listed on the website are in euros and include taxes. They are valid only on the day of the order.
  • 6.2 Payment Methods: Clients can pay via the web directly, Apple Pay, Payment by bank transfer will delay shipping until funds are received.
  • 6.3 Invoicing: Electronic invoices will be issued after each payment.
  • 6.4 Non-Payment: Late payments will incur penalties and may lead to additional fees.
  • 6.5 Ownership: The products remain the property of the Publisher until payment is made in full.

7. Customer Service, Withdrawal, and Warranties

  • 7.2 Withdrawal: Clients have 14 days to exercise their right of withdrawal without penalty, except for return shipping fees.
  • 7.3 Contract Cancellation: Clients may cancel the contract if delivery is delayed beyond seven days.

  • 8.1 Applicable Law: The general conditions are governed by French law.
  • 8.2 Modifications: The Publisher may modify these conditions at any time.
  • 8.3 Dispute Resolution: In the event of a dispute, clients are encouraged to resolve the issue via mediation or use the European dispute resolution platform.
  • 8.4 Entire Agreement: The invalidity of any clause will not affect the remaining provisions.
  • 8.5 Non-Waiver: The Publisher’s failure to enforce any right shall not be deemed a waiver of such rights.

ARTICLE 5: Ordering Process

ARTICLE 6: PRICES AND PAYMENT

6.1. Prices

  • Prices are those displayed on the website at the time of ordering and may be subject to change. These prices are in euros, inclusive of all taxes, but exclude delivery fees.

6.2. Payment Method

  • Payments can be made using VISA, MC, wire transfer. 
  • For card payments, the publisher does not access the client's payment details, as payments are processed directly by the bank.
  • Delivery timelines for cheque, mandate, or bank transfer payments begin only after payment has been received.

6.3. Invoicing

  • The publisher will send an invoice electronically after each payment, and the client agrees to receive invoices this way.

6.4. Non-Payment

  • Any delay in payment incurs late penalties at a rate three times the legal interest rate, along with a €40 recovery fee and an additional 20% penalty on the outstanding amount.
  • The publisher may also terminate the contract in case of non-payment.

6.5. Retention of Ownership

  • Products remain the property of the publisher until full payment is received.

ARTICLE 7: CUSTOMER SERVICE

ARTICLE 8: PERSONAL ACCOUNT

8.2. Account Content

  • The account allows clients to view their order history, though these records are for informational purposes only and are not legally admissible evidence in court.

8.3. Account Deletion

  • The publisher may delete accounts for violating terms, providing false information, or inactivity for over a year. This deletion does not entitle the client to any compensation.

Article 10. Editor's Responsibility

  1. Obligation: The editor commits to providing high-quality products but only assumes a "best-efforts" obligation.
  2. Force majeure and Client fault:
    • Force majeure: Circumstances beyond the editor’s control (like natural disasters, government actions, hacking, or strikes) exempt the editor from liability.
    • Client fault: Misuse of the service, negligence, or providing inaccurate information can place responsibility on the client.
  3. Technical Issues: The editor cannot be held liable for technical problems (e.g., access issues or hyperlink problems) or visual inaccuracies due to screen settings.
  4. Damages: Liability is limited to direct damages, excluding indirect damages (e.g., lost data or profits). Compensation is capped at the product’s purchase price.

Article 11. Intellectual Property

  1. Legal Protection: Content is protected by intellectual property laws. Unauthorized use can lead to legal action.
  2. Contractual Protection: Clients agree not to misuse site content, which includes respecting copyright and intellectual property rights.
